The refusal of the English to assist him did not fail to render him more deeply hostile than ever to them.

THREE:The Ministers, instead of making rational concessions to the demands of the people for Reform, proceeded without delay to fresh aggressions on their liberties. Not contented with the existing suspension of the Habeas Corpus Act, and with introducing into the Lords a Bill for the protection of the king's person and Government, they passed a law prohibiting all political meetings, and another to extend the law of treason; they recommenced arrests and prosecutions, and sent out shoals of spies and informers, so that all the safeguards of public liberty were completely annihilated. These despotic measures did not pass without energetic opposition and a good deal of violent language from Fox; but all remonstrance was useless against Pitt's majority. Still the alarm of the Government was not allayed. On the 8th of December the king sent a message to both Houses, reiterating his assurance of an earnest desire to negotiate peace with France. The Opposition very properly pointed out that, so far as France was concerned, victorious in its armies, and as anti-monarchical in its government as ever, there were less hopes of any consent on its part to peace than when the Opposition had so repeatedly urged the same measure. Holkar fled to join Scindiah and the Rajah of Berar, and the Peishwa entered his own capital in the month of May. General Wellesley, being put into full command of all the troops serving under the Peishwa and the Nizam of the Deccan, and being also director of the civil affairs of the British in those provinces, made arrangements for their security, and then marched after Scindiah and the Rajah of Berar. After various marchings and counter-marchings, in consequence of their movements to avoid him, he came up with them near the village of Assaye, or Assye. General Stevenson, who had repulsed them from the territory of the Nizam, was also encamped only eight miles off. On coming in sight of them, Wellesley found them fifty thousand strong, with a splendid body of Mahratta cavalry, whilst he had only four regiments of cavalry, three of them being native, and seven battalions of infantry, five of them Sepoys. He determined, however, to attack them at once, and, sending word to Stevenson to come up, he crossed the river at a ford in face of the artillery of the enemy, and, after a sharp encounter, routed them before Stevenson could arrive. The Mahrattas had ninety pieces of artillery, with which they did terrible execution till the cavalry could come to close quarters with them, and the infantry reach them with their bayonets; then they fled headlong, leaving behind all their cannon (September 23rd, 1803). The Mahrattas rallied in the village of Assaye, and it required a desperate effort to expel them. It was dark before it was accomplished. General Stevenson had been prevented from crossing the river, and did not come up till the next day, when Wellesley sent him in pursuit of the enemy's infantry, which had been abandoned by the cavalry, and was thus exposed to attack.

THREE:Wolfe raised batteries at Point Levi and on the island, and bombarded the town, but he could not draw the wary Montcalm from his strong position. In his front lay the river and some unapproachable sandbanks, behind and around him rocks and dense woods inaccessible. Once only he made a rush across the river, and endeavoured, with a detachment of one thousand six hundred men, to gain the batteries on Point Levi; but his troops soon saw the attempt to be hopeless, and retired. The Centurion man-of-war was placed to engage a battery which swept the place of landing, and then the troops were conveyed in boats, which drew little water, towards the shore. Some of these, however, got entangled amongst rocks, and created a delay in getting them off. By this time the French were hurrying down towards the landing-place with their artillery, and began to fire murderously from the banks above upon them. Wolfe, seeing that Townshend would cross the ford before they were ready to co-operate, sent an officer to recall him. At this time, the Grenadiers having reached the beach, rushed forward upon the entrenchments before the rest of the troops could be got out of the boats to support them. They were met by such a destructive fire that they were compelled to fall back with much slaughter. By this time night was setting in, attended by a storm, the roaring of which, mingling with the roar of the mighty St. Lawrence as the tide fell, seemed to warn them to recover their camp. The word was given to re-cross the river, and they made good their retreat without the French attempting to pursue them, though the Indians lurked in the rear to scalp such of the dead and such of the wounded as could not be brought off.

He had four native infantry regiments, containing a large number of young soldiers, whom the mutinous Sikhs had impressed with a great horror of the Khyber Pass. The only cavalry he had was a troop of irregular horse, and the only guns, four pieces of Sikh artillery. Besides, the owners of the camels, which had been hired at Ferozepore to proceed as far as Jelalabad, refused to advance farther than Peshawur. It was in these circumstances that Sale and M'Gregor earnestly urged the advance of the brigade for the relief of that place. The fortress of Ali Musjid, regarded as the key to the Khyber Pass, is situated about[498] twenty-five miles from Peshawur: and as it lay between the two positions of Sale and Wild, it was of the utmost importance that it should be occupied. It was accordingly resolved that one-half of Wild's brigade should be dispatched for this service. On the 15th of January Colonel Moseley, with the 53rd and 64th Sepoy Regiments, started under cover of the night, and reached their destination early in the morning. The fortress was about five miles up the Pass. Soon after they had taken up their position they discovered to their dismay that owing to some mistake, instead of 350 supply bullocks, which had been ordered, only fifty or sixty had arrived. Here, then, were two regiments shut up in an isolated fortress without provisions. Day after day passed and no succour came. Wild made an effort to send forward supplies, but the attempt was a disastrous failure. The Sikh auxiliaries mutinied to a man, and refused to enter the Pass. There being no prospect of relief, Colonel Moseley determined to evacuate the fortress. Captain Burt and Captain Thomas offered to remain and keep possession of so important a position, if only 150 men would volunteer for the service. But none were found willing to undertake the perilous duty, and so Ali Musjid was abandoned and suffered to fall into the hands of the Afreedis. The brigade had some fighting on its way back. TWO:But a brave and liberal member of the peerage, Earl Stanhope, did not flinch from endeavouring to get repealed a number of these disgraceful evidences of Church bigotry, which still cumbered the Statute book from long past periods. In May, 1789, a few days after Mr. Beaufoy's second defeat on the question of the Test and Corporation Acts, Lord Stanhope proposed "a Bill for relieving members of the Church of England from sundry penalties and disabilities to which, by the laws now in force, they may be liable, and for extending freedom in matters of religion to all persons��Papists only excepted��and for other purposes therein mentioned." His Lordship had given notice of his intention to introduce such a Bill in the previous February, as Mr. William Smith had done in the Commons, when what was called the Uniformity Clause in the Regency Bill was discussed, contending that this clause, which prohibited the Regent from giving the Royal Assent to the repeal of the Act for Uniformity passed in the reign of Charles II., might prevent the repeal of a preceding Act, of a very bigoted character, of a previous date. The Bishops, with the Archbishop of Canterbury at their head, opposed his intention,[161] contending that this was not a proper time for such a discussion. Lord Stanhope now detailed the names, dates, and characters of the Acts which he had in view. They were these:��The Act of 1 Elizabeth, ordering every person to go to church, and imposing a fine of twenty pounds��a very large sum then��on any one above the age of sixteen absenting himself or herself from church for a month; and in case of non-payment, ordering the imprisonment of the offender till the fine were paid, or the offender conformed. In case of twelve months' absence, the offender was to be bound in a bond of two hundred pounds, with two sureties, for his compliance in future. By the 23 Elizabeth these penalties were made still more rigorous, and by the 35th of her reign, all persons who absented themselves for a month were liable not only to the twenty pounds a month, but that money might be refused, if tendered, and the offender be deprived of two-thirds of his lands, tenements, and hereditaments, instead of the twenty pounds. By the 3 James I. these abominable powers were extended, and every person was made amenable for every visitor, servant, and servant of visitors to his or her house, and should be compelled to pay ��10 per month for the non-attendance at church of each of them; and over and above all these penalties, the ecclesiastical courts might as fully exercise their jurisdiction over these offenders as if no such special Acts existed.The duties on bricks and tiles were opposed, as affecting brick-makers rather than the public, because stones and slates were not included. These duties were, however, carried, and the Bill passed; but great discontent arising regarding the duties on coals and on licences to deal in excisable commodities, the Chancellor of the Exchequer was obliged to produce a supplementary Budget, and, after withdrawing these, to lay others on the sale of ale, gold and silver plate, the exportation of lead, and postage of letters, at the same time limiting the privilege of franking. It was high time that the latter practice were put under regulation, for the privilege was enormously abused. Till this time, a simple signature of a member of Parliament, without name of the post town whence it was sent, or date, freed a letter all over the kingdom. Many persons had whole quires of these signatures, and letters were also addressed to numbers of places where they did not reside, so that, by an arrangement easily understood, the persons they were really meant for received them post-free. The loss to Government by this dishonest system was calculated at one hundred and seventy thousand pounds a year. By the present plan, no member was to permit any letter to be addressed to him except at the place where he actually was; and he was required, in writing a frank, to give the name of the post town where he wrote it, with the dates of day and year, and to himself write the whole address.Custom

TWO:Next came the enactments regarding fasting. By 5 Elizabeth every person who ate flesh on a fish day was liable to a penalty of three pounds; and, in case of non-payment, to three months' imprisonment. It was added that this eating of fish was not from any superstitious notion, but to encourage the fisheries; but by the 2 and 3 Edward VI. the power of inflicting these fish and flesh penalties was invested in the two Archbishops, as though the offence of eating flesh on fish days was an ecclesiastical offence. Lord Stanhope showed that the powers and penalties of excommunication were still in full force; that whoever was excommunicated had no legal power of recovering any debt, or payment for anything that he might sell; that excommunication and its penalties were made valid by the 5 Elizabeth and the 29 Charles II.; that by the 30 Charles II. every peer, or member of the House of Peers, peer of Scotland, or Ireland, or member of the House of Commons, who should go to Court without having made the declaration against transubstantiation, and the invocation of saints therein contained, should be disabled from holding any office, civil or military, from making a proxy in the House of Lords, or from sueing or using any action in law or equity; from being guardian, trustee, or administrator of any will; and should be deemed "a Popish recusant convict." His Lordship observed that probably the whole Protestant bench of bishops were at that moment in this predicament, and that he had a right to clear the House of them, and proceed with his Bill in their absence. He next quoted the 1st of James I., which decreed that any woman, or any person whatever under twenty-one years of age, except sailors, ship-boys, or apprentices, or factors of merchants, who should go over sea without a licence from the king, or six of his Privy Council, should forfeit all his or her goods, lands, and moneys whatever; and whoever should send such person without such licence should forfeit one hundred pounds; and every officer of a port, and every shipowner, master of a ship, and all his mariners who should allow such person to go, or should take him or her, should forfeit everything they possessed, one half to the king, and the other half to the person sueing. "MY DEAR LORD ANGLESEY,��I have been very sensible, since I received your last letter, that the correspondence which that letter terminated had left us in a relation towards each other which ought not to exist between the Lord-Lieutenant and the king's Minister, and could not continue to exist without great inconvenience and injury to the king's service. I refrained from acting upon this feeling till I should be able to consult with my colleagues, and I took the earliest opportunity which the return to town of those who were absent afforded to obtain their opinion, which concurred with my own. Under these circumstances, having taken the king's pleasure upon the subject, his Majesty has desired me to inform you that he intends to relieve you from the Government of Ireland. I will shortly notify the arrangements which will become necessary in consequence.
